Terms of Service

These Terms of Service govern your use of the Achromatic website and your purchase and use of Achromatic source code, templates, documentation and updates. By using the website or purchasing Achromatic, you agree to these Terms. If you purchase for a team or organization, you represent that you have authority to bind it.

Achromatic provides source code and access to private GitHub repositories. The product, price and currency shown immediately before payment form part of your purchase. Unless checkout states otherwise, a purchase includes the current Prisma and Drizzle starter kits plus updates made available for those kits.

Select the purchase button to open Stripe Checkout. Enter the requested contact, payment and GitHub information, review the order and correct any errors before submitting payment. We accept the order when payment succeeds and the product is made available. We then display or send a confirmation and provide private repository invitations, access instructions or both.

You are responsible for providing a valid email address and GitHub handle. GitHub invitations can expire. We can reissue an invitation after verifying the purchase through the license activation page or support.

Stripe processes payments under its own terms. You authorize the charge shown at checkout. Any taxes collected are shown before payment. Hosting, databases, email services and other third-party costs are not included.

Because private source code can be copied immediately, all sales are final once we deliver private source access by making source code available or sending a private repository invitation. By purchasing, you request immediate delivery and consent to performance beginning immediately. We do not offer change-of-mind refunds, credits or exchanges after delivery. This does not limit any remedy or right that cannot be waived under applicable law.

If access was not delivered because of an error on our side, contact us so we can restore it.

Your use of the product is governed by the Achromatic License, which forms part of these Terms. If these Terms conflict with the License about permitted use of the product, the License controls.

Keep purchase links, repository access and account credentials secure. You may request access for developers who belong to the licensed individual, team or organization. You may not share access with clients, unrelated contractors or another organization unless Achromatic gives written permission.

Lifetime access means ongoing access to the purchased source code and updates that Achromatic makes available for it, subject to compliance with the License. It does not guarantee a particular feature, release schedule or continued compatibility with every dependency or third-party service.

Support covers reasonable questions about purchase access and the starter kits. Custom implementation, deployment and debugging of your modified application are not included unless agreed separately.

The product includes or integrates third-party software and services. Their own terms, licenses, availability and fees apply.

You may not misuse the website, interfere with its operation, bypass access controls, access another customer's information or use Achromatic unlawfully. You remain responsible for reviewing, testing and securing every application you build with the product.

Achromatic and its licensors retain ownership of the product, website, branding and related intellectual property. Your purchase grants a license, not ownership of the underlying product. You retain ownership of original work you add, subject to Achromatic's rights in the product.

To the fullest extent permitted by law, the website and product are provided "as is" and "as available." We do not warrant uninterrupted access, error-free operation or fitness for a particular purpose. You are responsible for deciding whether the product meets your requirements and for reviewing it before production use.

To the fullest extent permitted by law, Achromatic is not liable for indirect, incidental, special or consequential loss, including lost profits, lost data or business interruption. Achromatic's total aggregate liability arising out of or relating to the website, product or these Terms is limited to the license fee actually paid for the purchase giving rise to the claim. This is a limit on recoverable damages only. It does not create a right to a refund, cancellation or repayment. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.

We may suspend repository access or terminate a license for a material breach of these Terms or the License. When a license ends, the rights granted under it end. Provisions that by their nature should survive termination remain in effect.

We may update these Terms for future purchases or future use of the website. We will post the revised version with a new update date. The version in effect when you purchase continues to govern that purchase unless applicable law requires otherwise or you agree to a change.

These Terms are governed by the laws of Switzerland, without regard to conflict-of-law rules. Mandatory consumer protections and venue rights remain unaffected.
